Our New Jersey DWI attorneys recently defended a client who was arrested and charged with assault by auto after crashing into another car and injuring the occupants inside. The injuries were very serious and the victims of the accident had to be transported to a local hospital for surgery. After the police had taken care of everyone that was injured, their attention turned to our client who smelled like she had been drinking alcohol. Based on her admissions and the subsequent police investigation our client was charged with a DWI and also arrested for a felony because she injured people while drunk driving. This meant our client not only faced the New Jersey DWI penalties but was facing up to 3 – 5 years in state prison if convicted. Once in court our attorneys challenged the evidence against our client and after several court appearances, the County Prosecutor’s Office acknowledged the defenses that we had raised and agreed to downgrade the criminal charges and remand the DWI and assault to municipal court.
Once in municipal court, we continued to fight for our client and we were able to further challenge the State’s evidence. This ultimately resulted in a dismissal of the DWI and a dismissal of all criminal charges. Our client was able to keep her record intact and avoid losing her job.
