DWI vs. DUI in New Jersey

Many times we receive calls from individuals that have been charged with a drunken driving related offense. DUI and DWI is the same statute in New Jersey driving while intoxicated there is no delineation or differentiation between DWI and DUI in the state of NJ.

Sometimes people use driving while intoxicated (DWI) in the context of drugs while New Jersey but there’s only one law in New Jersey that regulates drug and alcohol related offenses. If you are caught driving with a blood alcohol concentration (BAC) of .08% or higher, you will be cited for driving under the influence (DUI) under N.J.S.A. 39:4-50 and 39:4-50.4a.
