Gloucester City is one of the busiest municipalities in Camden County for DWI charges. As many as two-hundred DUI offenses are issued annually within the 2.78 square miles of the town.  Many of those arrested are motorists crossing the Walt Whitman Bridge to and from Philadelphia along Interstate 76. Irrespective of where you were stopped in the town once known as “Fort Nassau”, our attorneys are equipped to effectively defend you. The team at The Law Offices of Jonathan F. Marshall has credentials in this area of law that are truly exceptional. We not only have over 100 years of experience, including years serving as prosecutors, but some of the most in depth training that is available in drunk driving defense. Three of the lawyers on our staff are among a small group of approximately eight (8) who are certified on the Alcotest and as instructors in Standardized Field Sobriety Testing. These are primary tools used to establish that someone is intoxicated and our staff has more education in these disciplines than most police officers on the job in Gloucester City. Paul Dougherty, Esq., is the prosecutor who represents the state. You may obtain directions to the court by clicking here.

The court lacks authority to downgrade or dismiss your DWI without a genuine basis to conclude that the charge is factually or legally defective. There is no ability to relax the mandatory minimum penalties set forth in N.J.S.A. 39:4-50 unless the prosecutors is unable to prove the offense. Plea bargaining is strictly prohibited. Your attorney will have to successfully persuade the court that the violation is lacking in some fundamental element or your must be subjected to the fines, surcharges, IDRC, license suspension, jail time and other penalties that apply under 39:4-50. Failure to raise a bona fide issue that prevents a conviction for DWI/DUI results in, for example, a 3-12 months license suspension for a first offense, 2 years for a second offense and 10 years for a third offense.
