School Zone Drug DUI Dismissed – No Loss of License

We recently defended a client who was stopped on his way home from the city after coming out of the tunnel. Port Authority Police pulled him over for a simple motor vehicle infraction but things quickly escalated when police officers smelled weed in the car. Based on the officer’s observations and the fact that our client admitted to smoking marijuana earlier, he was arrested for a Drug DUI, for being under the influence of a controlled dangerous substance – marijuana. Moreover, because the area where he was arrested has a school-owned property nearby, he was also arrested for DWI in a School Zone which carries a 1 – 2 year loss of license for a first offense.

Our client was a prominent businessman who was distinguished in his industry and he was adamant that he could not afford to be convicted of a DWI because it would ruin his reputation and damage his business. Our New Jersey DWI attorneys challenged the police officer’s investigation and the evidence against our client. In the end, the prosecutor conceded they could not prove the case based on the defenses that we raised and the Judge granted our motion to dismiss all the DWI charges. Our client was able to walk out of court with never losing his driver’s license. If you or your loved has been charged with a DWI or DUI in a School Zone, contact us today to learn more about how we may be able to help you during a free initial consultation.
